1. Platform Role
Occushare is an online marketplace that connects space hosts with guests seeking short-term venue rentals by the hour. Occushare facilitates the booking process, holds payments on behalf of hosts, and releases funds to hosts after bookings are completed.
Occushare is not the owner or operator of any listed space unless explicitly stated. Hosts are independent third parties responsible for their listings, space access, safety compliance, and adherence to local laws.
By using Occushare, you acknowledge that Occushare acts as a marketplace intermediary and that the rental agreement for any specific booking is between the guest and the host.
2. Eligibility and Accounts
You must be at least 18 years of age to create an account or make a booking on Occushare. By registering, you confirm that the information you provide is accurate and complete.
You are responsible for all activity conducted under your account. Do not share login credentials or allow others to use your account. Occushare reserves the right to suspend or terminate accounts where misrepresentation or misuse is detected.
Occushare currently authenticates users via Google OAuth, which provides a verified email address as a base level of identity assurance. Additional verification steps including phone number validation are required before a booking can be submitted.
3. Listings and Booking Rules
Hosts must provide accurate, current, and complete information in their listings, including photos, pricing, capacity, house rules, permitted activities, and any material limitations of the space.
All new space listings are reviewed by the Occushare admin team before being made publicly visible on the platform. Occushare reserves the right to reject or remove any listing that does not meet platform standards.
Guests must read all listing details and house rules before submitting a booking. Confirming a booking constitutes agreement to the specific listing's rules, capacity limits, and permitted activity scope.
Occushare may remove listings or suspend accounts for inaccurate, unsafe, misleading, or prohibited content at our sole discretion and without prior notice.
4. Payments, Marketplace Funds Flow, and Service Fees
Occushare operates a marketplace payment model. All payments are processed through Paystack, a PCI-DSS compliant third-party payment provider. Guests pay Occushare at the time of booking — not directly to the host. Occushare is a marketplace that facilitates payments through a licensed payment provider; it is not a bank, deposit-taker, or escrow agent, and guest funds are held within Paystack's regulated environment rather than in Occushare's own accounts.
Your payment is charged at the time you complete checkout. The captured funds are then held on behalf of the host, through Paystack, pending the outcome of the booking.
When a host has enabled instant booking, your booking is confirmed automatically as soon as payment succeeds.
When instant booking is disabled, your payment is still captured at checkout, and your booking is held as a request awaiting host approval. The host has a set review window to accept or decline. If the host accepts, the booking is confirmed. If the host declines, or does not respond within the review window, you receive a full automatic refund (including the service fee).
After a booking is completed, Occushare releases the host's earnings — the booking amount less Occushare's service commission — as a payout to the host's registered banking details via Paystack's transfer infrastructure. To receive payouts, hosts must add valid banking details once a listing is approved. These details are held securely by Paystack; Occushare does not store a host's full bank account number.
Guests are charged in South African Rand (ZAR). Total charges displayed at checkout include the base rate and Occushare's service fee (10%), plus any applicable taxes.
Hosts are solely responsible for any tax obligations arising from earnings received through the platform, including VAT where applicable.
5. Cancellations and Refunds Policy
Refund outcomes depend on who initiates the cancellation. Because payment is captured at checkout, cancellations of paid bookings are resolved by refund (in full or in part) rather than by releasing an authorisation.
GUEST-INITIATED CANCELLATIONS: You may cancel a booking up until 48 hours before its start time. When you cancel within that period, the base booking amount is refunded to you, but the 10% service fee is non-refundable and is retained by Occushare. Within 48 hours of the start time, bookings can no longer be cancelled. If you cancel before completing payment, no charge is made and nothing is refunded because nothing was paid.
HOST DECLINES BOOKING REQUEST: If a host declines a pending booking request, the guest receives a full refund, including the service fee. Nothing is retained.
HOST CANCELS CONFIRMED BOOKING: If a host cancels a booking that has already been confirmed, the guest receives a full refund, including the service fee, regardless of timing. Repeated host cancellations may result in account penalties or suspension.
CANCELLATIONS BY OCCUSHARE: If Occushare cancels a booking — including where a slot is found to be unavailable at the time your payment is confirmed (for example, due to a simultaneous booking) — you receive a full refund, including the service fee.
DISRUPTED BOOKINGS: If a guest is unable to access a confirmed space due to host error, misrepresentation, or force majeure, they may submit a disruption claim within 24 hours of the booking start time. Occushare will review the claim and may issue a full or partial refund at our discretion.
Refunds are returned to the guest's original payment method via Paystack and may take 5–10 business days to reflect depending on the guest's bank.
Occushare reserves the right to make final determinations on disputed refund claims based on available evidence from both parties.
6. Acceptable Use Policy
By using Occushare, you agree not to use the platform for any purpose that is unlawful, harmful, deceptive, or prohibited under these Terms.
The following are strictly prohibited on Occushare:
— Listing or booking spaces for illegal activities, drug use, illegal gambling, or any activity that violates South African law
— Using a space for any activity not disclosed in the listing or agreed to by the host
— Exceeding the stated guest capacity of a space
— Harassment, threats, abuse, or discrimination against other users, hosts, or Occushare staff
— Submitting false, misleading, or fraudulent listings, reviews, or booking information
— Attempting to circumvent Occushare's payment system by arranging off-platform transactions
— Collecting, scraping, or harvesting data from the platform without authorisation
— Uploading malware, engaging in phishing, or attempting to compromise platform security
— Creating multiple accounts to abuse platform policies or evade suspensions
Occushare reserves the right to investigate suspected violations and take appropriate action including content removal, booking cancellation, account suspension, or referral to law enforcement.
7. Shared Bookings
Hosts may enable shared bookings, allowing multiple independent guests to book the same space during overlapping time periods up to the space's stated maximum capacity.
Each shared booking guest books and pays independently. The host is responsible for managing total occupancy and ensuring the space can safely and comfortably accommodate all confirmed shared bookings simultaneously.
Occushare tracks per-hour capacity across the booking range and will only permit a shared booking if sufficient capacity exists across every hour within the requested time window.
8. Disputes Between Guests and Hosts
If a dispute arises between a guest and a host — for example regarding space condition, access, or conduct — either party should report the issue through the platform within 48 hours of the booking ending.
Occushare will review reported disputes using available evidence including booking records, messages exchanged on the platform, and photos or documentation submitted by either party.
For damage claims, hosts must submit photographic evidence of damage within 48 hours of the booking end time. Occushare will review the claim and, where sufficient evidence is provided, may charge the guest's payment method or withhold pending payouts accordingly.
Occushare acts as a mediator in disputes and aims to reach a fair resolution for both parties. However, Occushare's decisions in disputes are final and binding on both guests and hosts as a condition of platform use.
Occushare is not liable for damages, losses, or disputes arising from transactions between guests and hosts beyond the value of the booking itself.
9. Content and Intellectual Property
You retain ownership of content you submit to Occushare, including listing photos, descriptions, and reviews. By submitting content, you grant Occushare a non-exclusive, royalty-free, worldwide licence to host, display, and promote it for platform operations and marketing purposes.
Do not submit content you do not have rights to use. Content that infringes third-party intellectual property rights, contains defamatory material, or violates these Terms will be removed.
10. Enforcement and Account Actions
Occushare may investigate reported misuse and take action including listing removal, booking cancellation, account limits, temporary suspension, or permanent termination.
Users who have been suspended may not create new accounts to circumvent enforcement actions. Doing so is a violation of these Terms and may result in further action.
Serious violations including fraud, identity theft, harassment, or illegal activity may be referred to South African law enforcement where legally required or appropriate.
11. Liability and Disclaimers
Occushare provides the platform 'as is' and makes no warranties, express or implied, regarding the suitability, safety, or legality of any listed space.
Occushare does not guarantee uninterrupted platform availability and is not responsible for losses arising from outages, technical errors, or third-party service failures.
To the maximum extent permitted under South African law, Occushare's total liability to any user in connection with the platform shall not exceed the total value of the booking(s) directly involved in the relevant claim.
12. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising under these Terms are subject to the exclusive jurisdiction of South African courts.
13. Changes to These Terms
Occushare may update these Terms from time to time. Material changes will be communicated to registered users and posted on this page with an updated effective date.
Continued use of the platform after updates have been posted constitutes acceptance of the revised Terms.
